1. Introduction
Welcome to Craig Fouché Photography.
These Terms & Conditions govern your use of this website and the purchase of photography services, workshops, products and related services offered by Craig Fouché Photography.
By accessing this website, submitting an enquiry, making a booking or placing an order, you agree to be bound by these Terms & Conditions together with our Privacy Policy and any other policies referenced on this website.
If you do not agree with these Terms & Conditions, please do not use this website.
2. About Craig Fouché Photography
Craig Fouché Photography provides professional commercial photography, private photography sessions, film and digital photography services, photography workshops, selected photographic products and related creative services.
Services, products and pricing may change from time to time without prior notice.
3. Enquiries and Quotations
Submitting an enquiry does not create a contract or reserve a booking.
Quotations are prepared according to the individual requirements of each assignment and may include a stated validity period.
Unless otherwise agreed in writing, quotations automatically expire once their validity period has passed.
4. Bookings
Photography assignments, workshops and production dates are confirmed only when:
- the project scope has been agreed;
- any required booking fee has been received;
- written confirmation has been issued by Craig Fouché Photography.
Until written confirmation has been issued, requested dates remain subject to availability.
Where practical, dates may be held provisionally for a limited period. Provisional bookings may be released if another client is ready to proceed before confirmation has been received.
5. Booking Fees
Where applicable, a booking fee is required to reserve studio time, production resources or workshop places.
The booking fee secures the agreed booking date and allows preparation to commence.
Should you choose to cancel your booking, the booking fee will ordinarily be retained as a reasonable cancellation charge reflecting the reserved time and preparation already undertaken.
Where Craig Fouché Photography is unable to fulfil the booking and no suitable alternative can reasonably be provided, payments relating to the affected booking will be refunded where appropriate.
Nothing in these Terms limits any rights available under applicable South African consumer legislation.
6. Products
Selected photographic products, precision camera accessories, workshop-related products and other photographic items are available through this website.
Many products are individually manufactured to order. Estimated production times published on product pages are intended as reasonable estimates only and may vary depending on workload, material availability and manufacturing requirements.
Product photographs are provided for illustration purposes. Minor variations in appearance, finish or materials may occur without affecting the intended function or quality of the product.
7. Pricing and Payment
Prices displayed on this website are subject to change without prior notice.
Applicable taxes, shipping charges and other fees will be displayed where required before payment is completed.
Accepted payment methods are displayed during checkout, on quotations or on invoices.
Orders and bookings will generally commence only after payment has been successfully received and cleared.
8. Shipping and Delivery
Shipping is provided in accordance with our Shipping Policy.
Estimated dispatch and delivery times are provided in good faith but cannot be guaranteed, particularly where courier delays, customs processing or circumstances beyond our reasonable control occur.
International customers remain responsible for any import duties, customs charges or local taxes imposed within their destination country unless expressly stated otherwise.
9. Returns
Returns are governed by our Returns Policy.
Certain products manufactured specifically to order may not be eligible for return except where required by applicable consumer legislation.
10. Photography Services
Every photography assignment is unique.
The quotation issued for your project defines the agreed scope of work, deliverables, licensing arrangements, fees, production requirements and estimated delivery schedule.
Additional services requested after acceptance of the quotation may be quoted separately.
Unless specifically agreed in writing, RAW files, working files and unfinished production material are not supplied.
11. Workshops
Workshop places are confirmed only after payment has been received and written confirmation has been issued.
Workshop descriptions specify the intended experience level and any equipment participants should bring.
Should circumstances require a workshop to be postponed or cancelled, participants may be offered an alternative date, transfer, credit or refund where appropriate.
12. Copyright and Image Licensing
Unless otherwise agreed in writing, Craig Fouché Photography retains copyright in all photographs, images, designs and creative works produced.
Clients receive a licence permitting the agreed use of supplied photographs as defined within the relevant quotation or licensing agreement.
Purchasing photography services, products or digital files does not transfer copyright ownership.
Images may not be copied, resold, redistributed, licensed to third parties or substantially altered beyond the permissions granted under the applicable licence.
Website content, including photographs, text, graphics, branding and logos, remains the intellectual property of Craig Fouché Photography unless otherwise stated.
13. Third-Party Services
Craig Fouché Photography may collaborate with carefully selected third-party providers, including specialist laboratories, workshop partners, courier companies, payment providers and technical service providers.
Where services are supplied directly by a third party, their own terms and conditions may also apply.
Craig Fouché Photography is not responsible for the independent policies or contractual obligations of third-party providers.
14. Website Use
You agree to use this website lawfully and responsibly.
You must not:

Craig Fouché Photography shall not be considered in breach of these Terms where performance is delayed or prevented by circumstances beyond reasonable control.

- internet or communications outages;
- equipment failure despite reasonable maintenance;
- transport disruption;
- illness or other unforeseen events.
Where practical, alternative arrangements will be discussed with affected clients.

These Terms & Conditions are governed by the laws of the Republic of South Africa.
Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the South African courts.

These Terms & Conditions may be updated from time to time to reflect changes in our services, legal obligations or business operations.
